General Assistance Program
Services to Non-Citizens
A. Persons who are illegally in the United States are not eligible for general assistance.
B. Legally admitted aliens who are not admitted for permanent residence are not eligible for general assistance.
C. Legal immigrants are not eligible for general assistance except for the following:
- Refugees admitted under Section 207 of the INA.
- Asylees admitted under Section 208 of the INA.
- Aliens whose deportation has been withheld under Section 243(h) of the INA.
- Veterans of the U. S. Armed Forces who were honorably discharged for reasons other than alienage, their spouses and dependent children.
- Active duty personnel of the U. S. Armed Forces, their spouses and dependent children.
- Legal permanent residents who have earned 40 quarters of coverage for Social Security purposes. Quarters worked after December 31, 1996, in which the alien received any federal means-tested public assistance shall not be considered to be a qualifying quarter.
- The Director may grant an exception to provide assistance on an emergency one-time basis.
